1. Acceptance of Terms
By downloading, installing, or using the Froorio application ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Important: These Terms constitute a legally binding agreement between you and Froorio. Please read them carefully.
We may update these Terms from time to time. Your continued use of the Service after any changes indicates your acceptance of the modified Terms.
2. Eligibility
To use Froorio, you must:
- Be at least 16 years of age (or the age of digital consent in your jurisdiction)
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable law
- Not have been previously suspended or removed from the Service
If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. Your Account
Registration
To use Froorio, you must register using a valid phone number. You agree to provide accurate information and keep it updated.
Account Security
You are responsible for:
- Maintaining the security of your device and account
- All activities that occur under your account
- Immediately notifying us of any unauthorised use
- Not sharing your account with others
Encryption Keys
Your encryption keys are generated and stored on your device. We do not have access to your private keys. If you lose access to your device without a backup, you may permanently lose access to your encrypted messages.
Warning: We cannot recover your encryption keys. You are solely responsible for backing up your data and keys.
4. Our Service
Froorio provides a secure messaging platform featuring:
- End-to-end encrypted text messaging
- Encrypted voice and video calling
- Encrypted file sharing
- Encrypted vault for document storage
- Group messaging
- Ephemeral (disappearing) messages
Service Availability
We strive to provide reliable service but do not guarantee uninterrupted access. We may:
- Perform maintenance that temporarily affects availability
- Update or modify features
- Suspend service due to security concerns
5. Acceptable Use
You agree NOT to use Froorio to:
- Violate any laws or regulations
- Send spam, unsolicited messages, or bulk communications
- Harass, threaten, or abuse other users
- Impersonate others or misrepresent your identity
- Distribute malware, viruses, or harmful code
- Attempt to access other users' accounts or data
- Interfere with or disrupt the Service
- Circumvent any security measures
- Use automated tools or bots without authorisation
- Share content depicting child sexual abuse material
- Engage in or facilitate terrorism or violent extremism
- Coordinate illegal activities
Violation of these terms may result in immediate account termination and reporting to law enforcement where required.
6. Your Content
You retain ownership of any content you send through Froorio. By using the Service, you grant us a limited licence to transmit and temporarily store (in encrypted form) your content solely to provide the Service.
Content Responsibility
You are solely responsible for:
- The content you share
- Ensuring you have rights to share that content
- Any consequences of sharing that content
No Content Moderation
Due to end-to-end encryption, we cannot access, review, or moderate the content of your messages. This means:
- We cannot filter or block specific content
- We cannot comply with content takedown requests for encrypted messages
- You are solely responsible for your communications
7. Encryption & Security
Froorio uses post-quantum cryptography to protect your communications:
Post-Quantum Protection
We implement Kyber768 (ML-KEM) for key exchange and Dilithium (ML-DSA) for digital signatures, both standardised by NIST. These algorithms are designed to be secure against quantum computer attacks.
Your Understanding
You acknowledge that:
- We cannot access your encrypted content
- We cannot recover lost encryption keys
- Security depends on your device security
- You are responsible for verifying contact identities
Legal Requests
While we cannot provide encrypted message content (as we don't have it), we may be required to provide limited metadata in response to valid legal process.
8. Intellectual Property
The Froorio name, logo, and application are protected by intellectual property laws. You may not:
- Copy, modify, or distribute the App
- Reverse engineer or decompile the App
- Use our trademarks without permission
- Create derivative works based on the App
Open Source Components
Froorio may use open-source software components, which are subject to their respective licences. These licences are available within the App.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:
- Merchantability or fitness for a particular purpose
- Accuracy, reliability, or completeness
- Uninterrupted or error-free operation
- Security from all threats
We do not warrant that:
- The Service will meet all your requirements
- The Service will be available at all times
- All errors will be corrected
- The Service is free from vulnerabilities
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FROORIO SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of data, profits, or business opportunities
- Damages arising from service interruption
- Damages arising from unauthorised access to your communications
- Third-party actions or content
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
11. Termination
By You
You may terminate your account at any time through the App settings. Upon termination:
- Your account will be deleted
- Your profile will be removed
- Pending messages will be deleted
- This action is irreversible
By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in abusive behaviour
- Create legal liability for us
- Are required to be removed by law
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer in the European Union, you may also benefit from protections under the laws of your country of residence.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms in the App
- Updating the "Effective Date" at the top
- Sending an in-app notification for significant changes
Your continued use after changes take effect constitutes acceptance of the modified Terms. If you disagree with changes, you must stop using the Service.
